These Terms govern Mitamaton’s online service and service features. Apple’s Standard Licensed Application End User License Agreement governs your license to the iOS app. If these Terms and Apple’s Standard EULA conflict about the app license, Apple’s Standard EULA controls. These Terms control your use of the service.
By using Mitamaton, you agree to these Terms.
Mitamaton is a personal-organization service with an AI assistant. It can help with briefs, calendar awareness, email triage, notes, captures, and other features you choose. The Privacy Policy explains what the service collects and who receives it.
Mitamaton is currently offered only in the United States.
You must be at least 13 to use Mitamaton. If you are under 18, your parent or legal guardian must review and authorize these Terms and your use of the service. Do not use the service if you cannot form this agreement.
You are responsible for your account and for keeping your sign-in method secure. Give us accurate information and tell us promptly if you believe someone else is using your account.
Some features require Mitamaton Pro, an auto-renewing subscription purchased through your Apple App Store account.
Apple manages billing, cancellation, and any available refund under its terms. Deleting your Mitamaton account does not cancel your App Store subscription. Billing continues through Apple until you cancel it.
Do not use Mitamaton to break the law, harm another person, infringe another person’s rights, gain unauthorized access, extract another user’s data, or probe, overload, or disrupt the service. Do not bypass service limits or security controls.
We may restrict or suspend an account when reasonably needed to protect users, the service, or the law.
You retain whatever rights you have in messages, notes, captures, connected data, and other material you provide. Connecting a service does not transfer ownership of that service’s data to Good Machines.
You give Good Machines permission to host, process, transmit, and display that material only as needed to provide, secure, and support the features you use or to comply with law. You are responsible for having the rights and permissions needed to provide the material and ask us to process it.
AI output can be wrong, incomplete, or out of date. Review anything important before relying on it or using it in an action. Output is general information, not medical, legal, financial, or other professional advice.
As between you and Good Machines, and to the extent permitted by law, you own the AI output generated for you. We assign to you any rights we may have in that output. Output is not guaranteed to be unique. Other people may receive the same or similar output, and output may resemble existing material.
You are responsible for deciding whether an output is accurate, appropriate, and lawful for your use.
We work to keep Mitamaton useful and available, but features may change, experience interruptions, or be discontinued. We will give reasonable notice of a material discontinuation when practical.
You may stop using the service and delete your account at any time. We may suspend or terminate access for a material violation of these Terms, a legal requirement, or a security risk. Sections that should reasonably continue, including ownership, disclaimers, liability limits, and governing law, survive termination.
We may update these Terms as the service or law changes. For a material change, we will give notice in the app or by email before the change takes effect and will post the new effective date. If a change requires your affirmative consent, we will ask for it.
If you do not agree to updated Terms, stop using the service before they take effect. Continuing to use the service after the effective date means you accept the updated Terms, except where law requires another form of consent.
To the maximum extent permitted by law, the service is provided “as is” and “as available.” Good Machines disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not promise that the service will always be available, secure, or error-free, or that AI output will be accurate.
To the maximum extent permitted by law, Good Machines is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities. Our total liability for claims related to the service will not exceed the amount you paid Good Machines for Mitamaton during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Nothing waives statutory consumer rights that cannot be waived by contract. Some states do not allow certain disclaimers or limits, so parts of this section may not apply to you.
Maryland law governs these Terms, without regard to conflict-of-law rules. Unless nonwaivable law permits you to bring a claim elsewhere, the state and federal courts located in Maryland have exclusive jurisdiction and venue. You and Good Machines consent to those courts.
You may not assign these Terms without our written consent. Good Machines may assign them as part of a merger, reorganization, financing, sale of assets, or transfer of the service.
If either side does not enforce a provision once, that is not a waiver of the right to enforce it later. A waiver must be in writing.
If a court finds part of these Terms unenforceable, that part will be enforced to the greatest extent allowed and the remaining parts will stay in effect.
